Prenuptial Agreements

A prenuptial agreement is written before marriage and is intended to provide a pre-determined resolution plan in the event that a marriage ends in divorce. It is important to note that there are limits to the areas that a prenuptial can address, and there are specific rules and steps that must be followed for the prenuptial agreement to be enforceable by a Court.

Prenuptial agreements are common when a unique premarital situation exists, such as the accumulation of significant assets or wealth by one or both parties, to protect an estate plan or children from a prior marriage, or if a particular party is to receive a family inheritance.
